Welcome to YesCleanerand its supporting services!
Before using YesCleanerand its supporting services, you must carefully read and fully understand
the entire "YesCleanerTerms of Service and User
Agreement" (hereinafter referred to as this "Agreement"). You
should pay special attention to the core provisions highlighted in bold, such
as the Disclaimer, Limitation of Liability, Rights License, Information Use
Rules, and Governing Law and Dispute Resolution. If you are under the age of
18, you must read this Agreement in the presence of your legal guardian and may
only use the Services with your guardian's explicit consent.
Unless you fully accept all
terms of this Agreement, please do not download, install, launch, or otherwise
use YesCleanerand its associated services (hereinafter
referred to as "Use"). If you use YesCleanerin any manner, you will be
deemed to have fully understood this Agreement, voluntarily become a party to
it, and assume legal responsibility for all terms and conditions.
1.1 This Agreement is a
legally binding document entered into between you and the Developer
(hereinafter referred to as the "Developer") regarding your
downloading, installation, and use of the YesCleanerapplication and related
services. Some services under this Agreement may be provided by the Developer's
affiliates or partners. Your use of such services constitutes your
acknowledgement and agreement to the relevant rights and obligations governed
by this Agreement.
1.2 The term
"User" or "you" in this Agreement refers to all natural
persons, legal persons, or other organizations that directly or indirectly use YesCleanerand its related services.
1.3 YesCleaneris a client application legally developed and operated by a
developer under the brand name YesCleaner. It provides you with a
posture correction training program professionally guided by Mr. Cat. Through
exercise, it helps you improve unhealthy postures such as forward neck, rounded
shoulders, and hunched back, reshape your posture, and enhance your temperament
and health.
1.4 This Agreement includes
the supplementary agreements, service rules, privacy statements, and other
documents that have been published by the Developer and subsequently updated
through system pop-ups, internal messages, official website announcements, etc.
Once officially released, the above content will become an integral part of
this Agreement, and you must comply with and be bound by it.
YesCleanerclient application through official pre-installation channels or
third-party platforms authorized by the developer . Any software version
obtained from channels not officially authorized by the developer is considered
an unofficial version. The developer does not guarantee its usability and
security, and users are solely responsible for any losses incurred as a result.
2.2 Users can independently
decide whether to use YesCleanerand related services and
whether to update them. If they no longer need to use them, they can stop using
them and uninstall the application.
2.3 Users are required to
equip themselves with qualified terminal devices and use the relevant network
services. Once you launch the YesCleanerapplication on your
terminal device, you will be deemed to have begun using YesCleanerand related services. You will be solely responsible for any
network communication fees (such as data usage) incurred.
2.4 Developers may provide
different software versions for different operating systems and terminal
devices. Users should obtain, download, and install the appropriate application
version based on the actual device conditions.
2.5 To enhance user
experience and service quality, the Developer will periodically update or
adjust the Software (including but not limited to feature optimization, version
upgrades, and development of new services). To ensure the security of YesCleanerand related services and to improve user service, the Developer
will, where possible, notify you of any updates to the Software and related
services, or updates to certain service content, through in-app notifications,
official website announcements, or other appropriate means. Users have the
right to choose whether to accept the updated version or service. If they do
not, some features will be restricted or unavailable.
2.6 Without the Developer's
express written authorization, no user may access or use YesCleanerand related services without authorization, including but not
limited to copying , adapting, disseminating, vertical searching, mirroring, or
trading.
2.7 Developers grant users
the right to use YesCleanerand related services for
personal, non-transferable, non-exclusive, and non-commercial purposes.
All other rights not
expressly authorized by this Agreement remain the property of the Developer.
Users must obtain the Developer's written permission before exercising such
rights. Failure by the Developer to exercise any of the aforementioned rights
does not constitute a waiver of such rights.
3.1 User Behavior
Requirements
You are solely
responsible for your use of YesCleanerand its related services.
Unless permitted by law or authorized in writing by the developer, you may not
engage in the following activities:
3.1.1 Use any plug-ins,
add-ons, systems or third-party tools not authorized or permitted by the
Developer to interfere with, damage, tamper with or otherwise affect the normal
operation of YesCleanerand related services.
3.1.2 Exploit or target YesCleanerand related services to conduct activities that endanger computer
network security, including but not limited to:
(1) Activities that
endanger network security, such as illegally intruding into other people's
networks, interfering with the normal functions of the network, stealing
network data, etc.;
(2) Using unauthorized data
or accessing unauthorized servers/accounts;
(3) Knowing that others are
engaged in activities that endanger network security, but still providing them
with technical support, advertising promotion, payment settlement and other
assistance;
(4) Accessing a public
computer network or another person's computer system without permission,
deleting, modifying, or adding stored information;
(5) Providing programs and
tools specifically designed to intrude into networks, interfere with normal
network functions and protective measures, steal network data, and other
activities that endanger network security;
(6) Forging network data
packet information (including but not limited to TCP/IP data packet names or
partial names);
(7) Attempting to interfere
with or disrupt the normal operation of the YesCleanersystem or website,
intentionally spreading malicious programs or viruses, or other acts that
disrupt or interfere with normal network information services;
(8) Attempting to probe,
scan, or test the vulnerabilities of YesCleanersystems or networks without
permission, or other acts that undermine network security.
3.1.3 Reverse engineer,
decompile, or otherwise attempt to obtain the source code of YesCleaner.
3.1.4 Any other violation
of laws and regulations, this Agreement, the Developer's relevant rules, or any
other violation of the legitimate rights and interests of others. If a user
violates the rules, the Developer reserves the right to review and delete the
content of reports and complaints, including but not limited to user
information and chat logs, at any time without prior notice, and to impose
penalties on the offending account, including but not limited to warnings,
function restrictions, and account bans, depending on the severity of the
violation, and to notify the offending account of the results through
appropriate means.
3.1.5 Users who have been banned
may appeal through mk13308958807@163.com. The developer will review the appeal
and make a reasonable decision on whether to change the penalty.
3.2 Content Publishing Specifications
When using YesCleanerand related services, users must consciously
abide by the Constitution, laws, regulations, and public order, and respect
social morality, the socialist system, national interests, citizens' legitimate
rights and interests, moral standards, and the authenticity of information. Users may not use YesCleanerand related services to create, copy, publish, or disseminate
content that contains the following:
(1) Content that attempts
to subvert state power, overthrow the socialist system, or incite secession or
undermine national unity;
(2) Content that violates
the basic principles established by the Constitution;
(3) Content that endangers
national honor and interests;
(4) Content that promotes
ethnic hatred, ethnic discrimination, and undermines national unity;
(5) Content that
disseminates terrorist or extremist ideas;
(6) Content that threatens
national security or leaks state secrets;
(7) Content that harms the
legitimate rights and interests or physical and mental health of minors;
(8) Content that incites
regional discrimination or regional hatred;
(9) Content that secretly
photographs or records others without their permission, thereby infringing upon
the legal rights and interests of others;
(10) Content that violates
national religious policies and promotes cults or superstitions;
(11) Fabricating and
spreading false information such as rumors, disrupting economic and social
order, or undermining social stability;
(12) Content that
disseminates violence, obscenity, pornography, gambling, murder, or terrorism
information or incites crime;
(13) Content that is
horrific, violent, bloody, highly dangerous, or harmful to the physical and
mental health of the performer or others;
(14) Content that endangers
network security or uses the Internet to endanger national security, honor, and
interests;
(15) Content that
intimidates, threatens, or conducts human flesh searches against others;
(16) Content that insults,
defames, or infringes upon the legitimate rights and interests of others;
(17) Posting commercial advertisements,
commercial solicitation information, excessive marketing information or spam;
(18) Content that infringes
upon the privacy, reputation, portrait rights, intellectual property rights,
and other legitimate rights and interests of others;
(19) Content that spreads
obscene language and harms social order and morality;
(20) Content involving
other people’s privacy, personal information or data;
(21) Comments using
languages other than the language commonly used on this website;
(22) Other information that
violates laws, regulations, public order and good morals, interferes with the
normal operation of YesCleaner, or infringes upon the
legitimate rights and interests of other users or third parties.
3.3 Complaint and reporting
mechanism
The developer has
established an open and transparent complaint reporting channel. Users can
submit reports of any illegal or inappropriate behavior, harmful dissemination
activities, or illegal or harmful information to the YesCleanerdeveloper team at mk13308958807@163.com. We are committed to
promptly accepting, investigating, and handling all complaints and reports,
working with users to maintain a safe and healthy online environment.
4.1 We prioritize the
protection of user personal information. When using YesCleanerservices, you may be required to provide necessary personal
information so that we can provide you with better services and corresponding
technical support. You acknowledge and agree that the Developer has the right to
access, use, store, and share your personal information, subject to compliance
with laws and regulations , this Agreement, and the Privacy Policy .
4.2 To protect your information
security and prevent your personal information from unauthorized access, use or
disclosure , the Developer will take the following measures:
( 1 ) Establish a
comprehensive safety management system;
( 2 ) Implement data
anonymization;
( 3 ) Deploy
industry-standard encryption technology;
( 4 ) Adopt other technical
means that are compatible with YesCleanerservices.
4.3 During your use of YesCleaner, we solemnly promise that we will never collect or use your
sensitive and important personal information, such as your bank card number,
third-party payment account and corresponding password, or ID number, without your
explicit authorization and consent. We strictly adhere to relevant laws,
regulations, and industry standards, and employ a series of rigorous technical
and management measures, including encrypted transmission and data
anonymization , to safeguard your information security. If any of this
important information is leaked due to your improper operation, you will bear
the resulting risks and losses.
4.4 We will not share your personal
information with any third party other than the Developer and its affiliates
without your prior explicit authorization, except in the following
circumstances:
( 1 ) You choose to share
with a third party ;
( 2 ) involving major
public interests such as national security and public safety ;
( 3 ) Personal information
is collected from legally disclosed information, such as legal news reports,
government information disclosure, etc.;
( 4 ) Disclosure or
provision is required by applicable laws and regulations, mandatory
administrative and judicial requirements, or is directly related to criminal
investigation, prosecution, trial and execution of judgments. Subject to
compliance with laws and regulations, when we receive a request to disclose the
aforementioned information, we will require the other party to produce
corresponding legal documents, such as a subpoena or investigation letter. We
will carefully review all requests to ensure that they have a legal basis and
are limited to data that administrative and judicial departments have the legal
right to obtain for specific investigation purposes;
( 5 ) To the extent
permitted by laws and regulations, to protect the life, property, and other
major legal rights and interests of other YesCleanerusers, developers, and
their affiliates, or for the safe and stable operation of YesCleanerand related services, such as detecting, preventing, and handling
fraud and other illegal activities and reducing credit risk (this does not
include disclosing or providing personal information for profit in violation of
the commitments made in Yesclear's Privacy Policy) ;
( 6 ) Other circumstances
permitted by laws and regulations .
4.5 If YesCleanercontains links to information or other services (including
websites) provided by third parties, you acknowledge and understand that the
third parties operating such services may require you to provide relevant
personal information. We specifically remind you to carefully review the user
agreements, privacy policies, and other relevant terms of such third parties,
properly protect your personal information, and only provide it to such third
parties when necessary. This Agreement (and other agreements and rules related
to YesCleaner, including but not limited to the YesCleanerPrivacy Policy) does not apply to any services provided by any
third party. The Developer assumes no legal responsibility for any consequences
arising from any third party's use of your personal information.
For more information on
user personal information protection, please refer to Yesclear's Privacy
Policy.
Without the written
permission of the Developer, Users shall not, on their own or authorize,
permit, or assist any third party to conduct the following actions with respect
to the information contained in YesCleanerand related services under
this Agreement:
5.1 Edit, organize, or
format information on YesCleanerand related services without
authorization , and display it on platforms or channels other than the source
pages of YesCleanerand related services;
5.2 Use any form of
identification technology , including but not limited to special marks and
special codes , to conduct , on your own or with the assistance of a third
party, traffic diversion, hijacking, or other actions that may adversely affect
the information or content of YesCleanerand related services;
5.3 Unauthorized copying,
reading, or using information from YesCleanerand related services for
commercial purposes, including but not limited to promotion, increasing
readership or pageviews;
5.4 Obtain information on YesCleanerand related services through scraping, malicious caching, or other
illegal means , or engage in other acts that infringe upon the platform's data
rights.
6.1 If you are a minor
under the age of 18, you must be accompanied by a guardian, receive detailed
guidance, carefully read this Agreement, and obtain your guardian's explicit
consent before using YesCleanerand its related services.
We strongly recommend that guardians supervise the minor's use of the Services
to ensure their reasonable and healthy use of the Services.
6.2 Minor users should be
aware that if they violate laws, regulations, or this Agreement, they and their
guardians will bear the corresponding legal responsibilities, including but not
limited to compensation for losses and elimination of negative impacts. Please
abide by the rules and maintain a safe online environment .
6.3 Developers strictly
adhere to relevant laws and regulations on the protection of minors and attach
great importance to the personal information security of minors. When filling
out personal information, minors should exercise caution under the guidance of
their guardians and refrain from disclosing sensitive information (such as ID
number, home address, etc.). If a guardian discovers any improper use by a
minor or risk of information leakage, they may contact us using the contact
information provided in this Agreement, and we will fully assist in resolving
the issue.
6.4 Special tips for
minors:
6.4.1 When using this
software and related services, young users must be under the full supervision
and guidance of their guardians, reasonably control usage time, avoid becoming
addicted to virtual online spaces, and develop healthy online habits. We
encourage minors to spend more time on real-world learning and socializing, and
fully utilize the positive value of the Internet.
6.4.2 Young users must
abide by the National Youth Internet Civility Convention:
(1) Be good at online
learning and avoid browsing harmful information;
(2) Communicate honestly
and in a friendly manner, and do not insult or deceive others;
(3) Strengthen
self-protection awareness and do not casually date online friends;
(4) Maintain network
security and do not disrupt network order;
(5) It should be beneficial
to physical and mental health and not indulge in virtual time and space.
7.1 If you violate this
Agreement or other terms of service, the Developer reserves the right to
independently determine and take appropriate measures based on the
circumstances. For any suspected violation of laws, regulations, or crimes, the
Developer will retain relevant records, report to the competent authorities,
and cooperate with investigations in accordance with the law.
7.2 If your violation of
this Agreement or other terms of service results in third-party complaints or
legal claims, you shall bear all legal responsibility. If the developer, its
affiliated developers, or its controlled developers are required to pay
compensation to a third party or receive administrative penalties from state
agencies due to your illegal or breach of contract, you shall fully compensate
the developer, its affiliated developers, or its controlled developers for any
direct and indirect losses (including but not limited to economic losses,
damage to goodwill, and legal costs) incurred as a result.
7.3 Developers will respect
and protect the intellectual property rights, reputation rights, right to name,
privacy rights, and other legal rights of legal and natural persons in
accordance with the law. You promise not to infringe upon the intellectual
property rights, personality rights (including but not limited to reputation
rights, right to name, privacy rights), or other legal rights of any third
party when creating, copying, publishing, or disseminating information using YesCleanerand related services. You will bear all legal responsibility for
all claims brought by third parties. If your infringement causes losses to the
Developer, its affiliated developers, or its controlled developers (including
economic losses, loss of goodwill, litigation costs, etc.), you will fully
compensate the Developer, its affiliated developers, and its controlled
developers for all direct and indirect losses.
8.1
You acknowledge and voluntarily accept that YesCleanerand
related services are provided "as is" based on existing technology
and conditions . While the developer will make every effort to ensure the
stable operation of the service and data security, due to technical limitations
and the objective existence of external risks, such as force majeure, network
virus or Trojan attacks, hacker intrusion, system failures, and third-party
service anomalies, these factors may cause service interruptions, data loss, or
other losses. You must fully understand these risks .
8.2
You understand and agree that the Developer reserves the right to modify,
suspend, terminate, or terminate YesCleanerand
related services , upon prior notice via public announcement, to ensure the
continued optimization and overall operation of the Services. In such event,
the Developer will not be liable or obligated to compensate users for such
actions.
9.1 The intellectual
property rights of the content provided by Developers on YesCleanerand related services (including but not limited to software,
technology, programs, web pages, text, images, graphics, audio, video, charts,
layout designs, electronic documents, etc.) belong to the Developers. The
copyright, patents, and other intellectual property rights of the software
relied upon by Developers in providing these services also belong to the
Developers. Without the Developer's permission, no one may use (including but
not limited to monitoring, copying, disseminating, displaying, mirroring,
uploading, or downloading content from YesCleanerand related services
through any robot, spider, or other program or device) without authorization.
9.2 Developers provide
technical support for the development and operation of YesCleanerand have full rights to all data and information generated during
the development and operation of YesCleanerand related services.
9.3 You must not, under any
circumstances, unauthorizedly use any trademarks, service marks, trade names,
domain names, website names, or other distinctive brand features of the
Developer (including but not limited to YesCleaner) (collectively, the
"Marks"). Without the Developer's prior written consent, you may not
display, use, or apply for trademark registration or domain name registration
for the aforementioned Marks, whether alone or in combination, nor may you
expressly or imply to others the right to display, use, or otherwise deal in
such Marks. You will assume full legal liability for any losses caused to the
Developer or others due to your use of the Developer's trademarks, Logos, etc.
in violation of this Agreement.
10.1
When using YesCleanerand
related services, you fully understand and agree that the Services may include
information publishing, advertising, or brand marketing services provided by
developers to individuals or businesses. You agree that developers have the
right to display service-related commercial advertisements, promotional
content, or third-party partner information (including both commercial and
non-commercial information) on YesCleanerand
related services.
10.2
If you do not agree to receive specific types of advertising information, you
can choose to turn off such advertising push through your system settings. For YesCleaner's push notification service, you have the right
to disable notification permissions or stop using the service through your
device's system settings.
10.3
Developers will strictly comply with the Advertising Law and other laws and
regulations in fulfilling their obligations. You must independently determine
the authenticity, legality, and reliability of advertising or promotional
information and are responsible for your own decisions. Unless otherwise
expressly provided by laws and regulations, you will be solely responsible for
any purchases, transactions, or any damages or losses incurred as a result of
such advertising or promotional information , and the Developer will not be
liable for compensation.
11.1 You should be aware of
and voluntarily assume the following risks: YesCleanerand related services may be
affected by various factors, including technology, network, and third parties.
The developer does not make any express or implied warranties for the services,
including but not limited to:
11.1.1 The developer is
fully suitable for the user's usage requirements
11.1.2 The Developer will
be uninterrupted, timely, secure, reliable, or error-free; and any software,
services, or other materials obtained by Users through the Developer will meet
Users' expectations;
11.1.3 All errors in the
software will be corrected in a timely manner.
11.2 Developers are
entitled to the right to handle illegal and infringing content in accordance
with this Agreement. This right does not constitute an obligation or commitment
on the part of the Developer, and the Developer cannot guarantee timely
discovery of illegal activities or appropriate handling.
11.3 Please acknowledge,
understand, and agree that the Developer does not provide any warranties or
conditions of any kind with respect to the Services covered by this Agreement
(including, but not limited to, implied warranties of merchantability and
fitness for a particular purpose). You assume all risks arising from the use of
this Service and related software, including data loss, equipment failure, and
business losses.
11.4 Please acknowledge,
understand, and agree that when using YesCleanerand its related services,
you may encounter force majeure and other factors (force majeure refers to
objective events that are unforeseeable, insurmountable, and unavoidable), such
as government actions, natural disasters, network problems, hacker attacks,
war, and other similar events. In the event of force majeure, the Developer
will strive to remedy the situation as soon as possible. However, you agree
that the Developer will not be liable for any losses caused by force majeure.
11.5 Please be aware,
understand, and agree that this Agreement is formulated to comply with national
laws and regulations, maintain public order and good morals, and protect the
legitimate rights and interests of others. Developers will do their utmost to
make judgments based on relevant laws and regulations within their
capabilities, but cannot guarantee that such judgments will be completely
consistent with those of judicial and administrative agencies. You clearly
understand and agree to bear the consequences that may arise from this.
12.1 This Agreement is
signed in Tianhe District, Guangzhou City, Guangdong Province, People's
Republic of China. If a dispute arises between you and the Developer, both
parties shall first attempt to resolve it through friendly negotiation. If no
agreement can be reached through negotiation, the dispute shall be submitted to
the People's Court with jurisdiction over Tianhe District, Guangzhou City,
Guangdong Province for resolution through litigation.
12.2 The formation,
validity, performance, interpretation, and dispute resolution of this Agreement
shall be governed by the laws of mainland China. If any provision of this
Agreement is held invalid or unenforceable due to a conflict with mainland
China law, such provision shall be adjusted to the maximum extent permitted by
law to conform as closely as possible to the original intent of the provision.
The remaining provisions shall remain unaffected and must continue to be fully
enforced by both parties.
12.3 You and the Developer
are independent legal entities. This Agreement does not constitute any agency,
partnership, joint venture, or employment relationship. Unless otherwise
expressly provided by laws and regulations, the Developer makes no warranties,
express or implied, and assumes no liability for any consequential losses or
incidental damages arising from the use of the Service.
12.4 The relevant terms of
this Agreement will be continuously refined and adjusted during software
testing and external release. We will publish the revised terms through appropriate
means and proactively notify you to review them. Once officially published,
these revised terms will become an integral part of this Agreement and have the
same legal force as this Agreement. Your continued use of YesManage after these
updated terms will be deemed your full acceptance of the revised terms. If you
object to the new terms, please immediately cease using YesManage; otherwise,
you will be deemed to have accepted all changes.
12.5 The titles of the
clauses in this Agreement are for ease of reading only and do not affect the
specific meaning or legal interpretation of the clauses themselves.
12.6 The copyright and
right of interpretation of this Agreement belong to the Developer. The
Developer reserves the right to modify and update the terms of this Agreement.
The modified terms will take effect from the date of publication.
